These terms apply to the website www.workishere.com, the WorkIsHere web app and the WorkIsHere apps for iPhone and Android (together, “the service”).

By creating an account or using the service, you accept these terms and our Privacy Policy. If you use WorkIsHere for a business, you also accept them for that business and confirm that you may do so.

You must be old enough under the law of your country to accept these terms. If you do not agree with them, please do not use the service.

WorkIsHere records attendance. Owners and managers create a business, mark their workplaces on a map and invite their employees. Employees check in and out with their phone’s location, and the app asks for their consent before the first check-in and records it.

Some features are optional and work only with the employee’s own permission. Auto-pilot stays off until the employee turns it on in the phone app and gives its own consent. A location check during a shift is answered in the background only on a phone where the employee opted in and allowed background location; otherwise it is a notification, and opening it shares a location once. The Privacy Policy explains exactly what is recorded and when.

Give accurate details and keep your password to yourself. You are responsible for what is done with your account, so tell us at once if you think someone else has used it.

The owner who creates a business is responsible for it: for the people they invite, the managers they appoint, and the business’s plan and payments.

The business (the employer) decides why and how its employees’ attendance is recorded. Under data protection law (the GDPR in the EU, KVKK in Turkey), it is the controller of its employees’ attendance and location data, and we process that data on its behalf, as its processor, only to provide the service.

The business must have a lawful basis for recording attendance, must tell its employees how it uses WorkIsHere, and must answer their requests about their data. We help it do so.

For the account and billing data of owners, and for running the service itself, we are the controller.

If your employer asked you to use WorkIsHere, your employer’s own rules about attendance apply to you too. Questions about how your records are used go to your employer first.

You must not use WorkIsHere to:

• track or locate anyone without their knowledge, or monitor people in a way the law where they work does not allow;
• check in for someone else, fake a location, or use another person’s account;
• invite people who have not agreed to join, or who do not work for your business;
• break, overload, probe or reverse engineer the service, or get around its limits or security;
• break the law or anyone else’s rights.

We may remove content or suspend an account that breaks these rules (see “Suspension and termination”).

• Free: the owner plus 1 people on the staff.
• Team: a fixed number of seats that you choose up front. The first seat is free, and every other seat costs $1 per month or $10 per year.
• Enterprise: by a separate written agreement.

The price is shown before you pay. Prices are in US dollars, and taxes may be added where they apply.

We may change our prices. We tell you in advance, and a new price applies from your first renewal after the notice. If you do not want to continue at the new price, you can cancel before then.

On the web, payments are handled by Stripe. WorkIsHere never sees or stores your card number.

In the iPhone app you pay through Apple’s App Store, and in the Android app through Google Play. Apple’s or Google’s terms then apply to the payment, including their refund process: refunds for those purchases are requested from Apple or Google.

A subscription renews automatically at the end of each period, monthly or yearly, until it is cancelled.

Cancel on the web in the payment portal on your business’s billing page (run by Stripe), or in the app in your Apple or Google subscription settings. The business keeps its plan until the end of the period it has paid for.

Adding seats is charged for the rest of the current period: on a monthly plan it is added to the next invoice, and on a yearly plan the rest of the year is charged at once.

Removing seats or cancelling gives no refund or credit for the current period, except where the law requires one.

If a payment fails, the business keeps its plan for 14 days while you fix it. After that, it moves to the Free plan: the person who joined first stays active, the others are paused and open invites over the limit are cancelled. Their records are kept, and once you subscribe again you can resume them.

You can delete your account at any time, in the app or on the Delete your account page. An owner first cancels any paid subscription and makes someone else an owner or archives the business.

Each business you worked for keeps its attendance records as its own personnel records until the end of the retention period it sets.

We work to keep WorkIsHere running well, but we provide it “as is” and “as available”. We do not promise that it will always be available or free of errors, or that every location reading is correct: GPS can be wrong by tens of metres.

We improve the service all the time and may change or remove features. If a change takes away something important that you pay for, we tell you in advance.

As far as the law allows, our total liability for all claims about the service is limited to the fees the business paid us in the 12 months before the claim.

As far as the law allows, we are not liable for indirect or consequential loss, such as lost profit, lost data, or decisions (for example about pay) taken on the basis of attendance records.

Nothing in these terms limits liability that the law does not allow to be limited, such as liability for intent or gross negligence, or for death or personal injury.

We may suspend or close an account that breaks these terms, puts the service or other people at risk, or when the law requires it. Where we can, we warn you first and tell you why.

You can stop using WorkIsHere at any time. If we ever stop offering the service, we tell you in advance so that you can take out your records.

WorkIsHere, its software, its design and its name belong to FreedX Technologies OÜ. While your account is active, you may use the service under these terms; this right is personal and cannot be transferred.

The data you and your business put into WorkIsHere stays yours. You give us only the permission we need to store and process it to run the service.

WorkIsHere runs on services from other companies:

• Supabase: the database and sign-in.
• Vercel: hosting of the website and the web app.
• Stripe: payments on the web.
• Apple: the App Store, Sign in with Apple and notifications on iPhone.
• Google: Google Play, Sign in with Google and Firebase Cloud Messaging (notifications on Android).

When you use these services directly (for example to pay or to sign in), their own terms also apply. We are not responsible for their services.

We may update these terms. We tell you in advance, in the service or by e-mail, and if you keep using WorkIsHere after the change takes effect, you accept the new terms.

If a change is significant, we ask you to accept the new terms before you continue. The version and date at the top of this page show which terms apply.

The law of Estonia applies to these terms. Disputes are settled by the courts of Harju County (Harju Maakohus) in Tallinn.

WorkIsHere is made for businesses. If you use it as a consumer, the mandatory consumer protections of the country where you live still apply, and nothing in these terms limits them.
